1. INTRODUCTION AND AGREEMENT

Welcome to Division Market. This website (www.divisionmarketsd.com) is operated by Division Market, located at 5402 Division St., San Diego, CA 92114. Throughout this document, the terms "we," "us," and "our" refer to Division Market.

By accessing or using our website and purchasing our products, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, please do not use our site.

We reserve the right to update or modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the site after changes are posted constitutes your acceptance of the new terms.

2. AGE RESTRICTIONS AND VERIFICATION

You must be 21 years of age or older to purchase alcohol from Division Market.

By placing an order that includes alcoholic beverages, you certify that:

You are at least 21 years old
The person receiving the delivery will be at least 21 years old
You understand that a valid government-issued ID will be required upon delivery

We utilize age verification pop-ups and checkout confirmations to ensure compliance. All alcohol sales are final and subject to additional verification at the time of delivery. Delivery drivers are required to check IDs and may refuse delivery if the recipient appears intoxicated or cannot present valid identification.

3. PRODUCT INFORMATION AND AVAILABILITY

We strive to display accurate information regarding our products, including descriptions, images, and pricing. However, we do not guarantee that product descriptions, images, or other content are completely accurate, current, or error-free.

All products are subject to availability. In the event that a product is out of stock after you place an order, we will contact you to offer a substitution or a full refund.

We reserve the right to limit quantities of any products and to discontinue products at any time.

4. PRICING AND PAYMENT

All prices are listed in U.S. dollars and do not include applicable taxes or shipping fees, which will be added at checkout.

By providing payment information, you represent that you are authorized to use the designated payment method. We reserve the right to refuse or cancel any orders that appear fraudulent or suspicious.

5. SHIPPING AND DELIVERY

Currently, Division Market ships only to addresses within the State of California. We do not ship internationally or to other states at this time.

We primarily utilize UPS and FedEx for shipments, though carriers may vary. Shipping costs and estimated delivery windows will be provided at checkout.

By placing an order, you agree to the following delivery conditions:

An adult (21+) must be present at the delivery address to sign for and accept delivery of alcohol products
If no adult is available, the carrier may attempt redelivery or hold the package for pickup
Division Market is not responsible for delays caused by the shipping carrier or by weather conditions

6. RETURNS, REFUNDS, AND DAMAGED GOODS

All sales are final, with the following exceptions:

Damaged During Shipping:
If your order arrives damaged due to shipping, please contact us within 48 hours of delivery at sales@divisionmarketsd.com with:

Your order number
Photos of the damaged product(s) and packaging
A description of the damage

We will work with you to issue a refund or replacement.

Spoiled Products:
If an alcohol product is spoiled or flawed (commonly referred to as "corked" or "skunked"), please contact us within 7 days of delivery with:

Your order number
Photos of the product (showing the bottle/can and any visible issues)
A description of the flaw

Refunds or replacements for spoiled goods will be issued at our discretion after review.

Non-Returnable Items:
Due to health and safety regulations, we cannot accept returns of toiletries, snacks, candy, or any opened non-alcohol products.

7. ACCURACY OF INFORMATION

We make every effort to ensure that product descriptions, pricing, and availability are correct. However, we do not warrant that product descriptions or other content on this site are completely accurate, reliable, current, or error-free.

If a product is listed at an incorrect price or with incorrect information, we reserve the right to refuse or cancel any orders placed for that product, regardless of whether the order has been confirmed or your credit card has been charged. If your credit card has already been charged and we cancel your order, we will issue a full refund.

8. ACCOUNTS AND GUEST CHECKOUT

You may choose to create an account with Division Market or check out as a guest.

If you create an account:

You are responsible for maintaining the confidentiality of your login credentials
You are responsible for all activities that occur under your account
You agree to provide accurate and complete information
You must notify us immediately of any unauthorized use of your account

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

9. INTELLECTUAL PROPERTY

All content on this website—including but not limited to logos, graphics, text, images, and product descriptions—is the property of Division Market or its content suppliers and is protected by copyright and trademark laws.

You may not reproduce, distribute, modify, or republish any content from this site without our prior written consent.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Division Market shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or products.

Our total liability to you for any claim arising from or related to these Terms or your purchase of products shall not exceed the amount you paid for the products giving rise to the claim.

11. INDEMNIFICATION

You agree to indemnify and hold Division Market and its owners, employees, and affiliates harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising from:

Your use of our website
Your violation of these Terms
Your violation of any rights of another party
Your purchase or consumption of our products in violation of applicable laws

12. GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising out of or relating to these Terms shall be filed exclusively in the courts located in San Diego County, California.

13. SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
